Unlock Opportunities: How to Secure an Open Work Permit for Your Spouse or Partner During Sponsorship
Navigating the journey of sponsoring your spouse, common-law, or conjugal partner for Canadian permanent residence is a significant step. One of the benefits of this process is the possibility for your loved one to apply for an Open Work Permit (OWP), enabling them to work in Canada while waiting for their permanent residence application to process. Here’s everything you need to know.
What is an Open Work Permit (OWP)?
An Open Work Permit allows your spouse or partner to work for most employers across various industries in Canada, without the need for a specific job offer. This permit can be a lifeline for families settling in Canada, providing financial stability and flexibility.
Who Can Apply for an OWP?
Your spouse or partner must meet these criteria:
- Be in a genuine relationship with the sponsor.
- Have submitted a permanent residence (PR) sponsorship application and received an Acknowledgment of Receipt (AOR) from Immigration, Refugees, and Citizenship Canada (IRCC).
- Reside in Canada with the sponsor.
Exclusions:
Your partner cannot apply if:
- The PR application is refused, withdrawn, or returned.
- They plan to apply for a work permit at a port of entry.
Key Steps to Apply for an OWP
- Submit a PR Sponsorship Application: Before applying for the OWP, ensure you’ve submitted the PR application.
- Create an IRCC Secure Account: The sponsored person must apply online through IRCC’s secure account.
- Complete the Application: Follow the personalized document checklist provided after answering the required questions.
Special Note:
If your partner’s temporary resident status is expiring within two weeks, they may apply for an OWP without an AOR under special circumstances.
Processing Timelines and Conditions
- Standard Processing: Applications typically take around four months.
- Expedited Visitor Visa Processing: Sponsored individuals who have received an AOR may also qualify for faster visitor visa processing.
- Legal Status Requirement: While waiting for the OWP, the sponsored person must maintain valid temporary resident status.
Important Details for the OWP Application
When filling out the “Details of intended work in Canada” section:
- Box 1 (Type of Work Permit): Select “Open Work Permit.”
- Box 4 (Job Title): Enter “SCLPC FC OWP.”
- Description of Duties: Enter “SCLPC FC applicant in Canada public policy.”
After Submitting the Application
- Work Authorization: Your spouse cannot start working until the OWP is issued.
- Current Work Permit Holders: If they have an existing work permit, they can continue working, provided they apply for the OWP before its expiry.
- Approval: IRCC will issue the OWP online and send it by mail.
Why Consider an OWP?
An OWP ensures your spouse or partner can actively contribute to your family’s journey in Canada, fostering independence and smoother integration into Canadian life. Start your application today and embrace the opportunities ahead!
