Cracking Down on Abuses in Canada’s Temporary Foreign Worker Program

Canada’s government, under Prime Minister Justin Trudeau, is considering bold new measures to address growing concerns about the exploitation of temporary foreign workers (TFWs). In an effort to strengthen the integrity of the country’s migrant labor system, the government may soon publicly name and shame business managers or owners who violate labor rules.

This initiative is part of a broader push to reform the TFW program, which has been criticized for its lax enforcement and the ease with which companies can exploit low-wage foreign workers. Responding to labor shortages, Trudeau’s administration previously raised the cap on low-wage TFWs to 20% of a company’s workforce, with certain sectors like construction allowed up to 30%. While this influx of workers has supported economic growth, it has also opened the door to widespread fraud and abuse.

Recent reports reveal that some foreign workers are paying exorbitant, illegal fees to unscrupulous immigration consultants in hopes of securing jobs—and a pathway to permanent residency. A government-commissioned investigation highlighted significant increases in such practices, with some workers paying between C$10,000 and C$180,000 for employment.

The government already maintains a database of companies found to be non-compliant, but officials believe that identifying the individual actors involved will serve as a stronger deterrent. Additionally, the government plans to scale back the low-wage TFW stream to pre-pandemic levels, aligning with a broader strategy to reduce non-permanent immigration, including international students.

While some business groups have voiced concerns that these reforms may restrict access to much-needed labor, the government remains committed to tightening oversight and eliminating the abuses tarnishing Canada’s TFW program.
