Canadian Federal Government Updates on Spousal Open Work Permits: Key Changes and Eligible Occupations

Big news for families of foreign workers in Canada! The Canadian federal government has updated the rules regarding Spousal Open Work Permits (SOWPs). This policy shift, effective January 21, could impact many aspiring workers and their loved ones. Here’s what you need to know.

🛠️ What’s Changed?

Previously, spouses of foreign workers could apply for a SOWP regardless of the foreign worker’s job category. However, under the new rules:

  • Spouses are eligible only if the foreign worker’s occupation falls under:
    • TEER 0 (Executive-level jobs)
    • TEER 1 (Professional roles)
    • Specific TEER 2 and TEER 3 occupations.

In addition, the foreign worker must have at least 16 months remaining on their work permit when their spouse applies.

Key Points to Note

  • These changes apply to applications made after January 21, 2024.
  • Existing valid work permits and eligible renewals are not affected.

This policy ensures that families of skilled workers in critical occupations can continue to reunite and thrive in Canada.

🔍 Understanding TEER Classifications

TEER stands for Training, Education, Experience, and Responsibilities. It’s a framework used in Canada’s National Occupation Classification (NOC) system to rank occupations based on skill level:

  • TEER 0: Highest skill level (e.g., executives).
  • TEER 5: Lowest skill level (e.g., entry-level roles).
