Fee Surge: Changes to H-1B Visa and Green Card Costs in the US

Exciting news! The US Citizenship and Immigration Services (USCIS) has recently announced revisions in certain immigration and naturalization benefit request fees.

This marks the first adjustment since 2016 and is aimed at providing better and more timely services to the people they serve. The final rule limits how much newly established fees may increase, ensuring that for most individual filers, the new fees will not increase by more than 26%, equivalent to the increase in the Consumer Price Index since the last fee rule was issued in 2016.

The new rule, effective from April 1, 2024, incorporates feedback from over 5,400 public comments. The rule allows half-price EAD applications for adjustment of status applicants and reduced fees for adjustment of status applicants under 14 in certain situations. Eligibility for a 50% fee reduction for naturalization applications is expanded to individuals demonstrating household income between 150% and 400% of the Federal Poverty Guidelines.

The final rule lowers the agency’s required annual cost recovery by $727 million, considering the budget effects of improved efficiency measures. The final rule expands fee exemptions for specific categories, including Special Immigrant Juveniles, victims of human trafficking, crime, and domestic violence, U.S. military service members, Afghan allies, and families pursuing international adoption.

The rule introduces special fee discounts for nonprofit organizations and small business employers. A standard $50 discount is implemented for online filers. Despite years of inadequate funding, the USCIS workforce has made great strides in customer service, backlog reduction, implementing new processes and programs, and upholding fairness, integrity, and respect for all they serve.

Congressional funding is needed to fully resolve challenges associated with recent border crossers.
